Why?

Because it is an area of law that is far from clear. The courts have stretched and pulled it to an incredible extent. It has gained vast popularity among the techno-geeks as a defense, even though many of their intended 'uses' of it fall well outside the limits of fair use.

My advice: Don't rely upon it unless you're doing so upon the guidance of an attorney. Even then, don't be surprised if something goes wrong. If you feel like you must use it and can not afford an attorney, at least spend an hour or two doing research on the internet. There are a few entities out there that are working hard to clarify this whole mess.

As for this particular case: If you want to stay well within the law and continue to enjoy the material, I advise going to Kinkos and getting a spiral binding. Very easy to use. No questions about legality.
 

TECHNICALLY, loaning a book to a friend could be argued to be an act of piracy (as I understand it). You have not been given the right to distribute the book, and the company could be losing profit, as your friend wouldn't have to buy the book to read it. However, no publisher in the world would even THINK about trying to stop the "illegal" practice of book-loaning, even if they were to regard it as such. Much like spriting and sprite-comicing, using a PDF copy of a bok you own probably falls under the "You could argue that it is illegal, but nobody really cares." If they were to go after you (Instead of the people on Kazaa who distribute the stuff) they would need to give a warning first, so you would have your answer then, and not have any legal problems. I say, go for it.

Would the open gaming licence cover part of this?
 

I don't really know why this issue is causing so much grief.

1.) Fair use doesn't technically apply to get a copy of something you own from somebody else.
2.) But, even if you did it, the case wouldn't go to court.
3.) Even if the publisher was really bored and had lawyers willing to try, it would be thrown out of court immediately. No court would bother trying a case involving a *possible* $40 in theft, when the person already owns it.
4.) It's still better not to download a copy. Downloading copies is the way to tell pirates that their work mattered. The less people pay attention to them, the more likely they'll find something better to do with their time.
 

You're right on #2 and #3. The only prudent thing is to stop the illegal distribution, if they can. If a web site is doing this unlawful act, then the publisher will take legal action against the host of that site, and will try to get compensation for the potential loss of revenue (from the many copies the host distributed, free or not). And if the product contains registered trademarks owned by said publisher they can get additional compensation.
 

Obviously, though, this is a moot point. Everyone posting on this thread has been noted by the government as a possible copyright crook and is being watched by tiny surveillance equipment meant to read our minds. ALl we can do is grab a metal collander, wrap it in tin foil and avoid all dairy products (to remove any chance of being further infected with government mind control microbes).

Because of this, we'd be fools to try using any PDFs that were not liscensed directly to us.
 

Government don't enforce IP laws (unless mass piracy is involved), IP owners enforce IP laws. The government's only role in this is settling the dispute in court.

Oh no! They've gotten to you. The only cure is to put yourself in a washing machine on "rinse" for an hour to destroy the microbes. I only hope it isn't too late.
