MI Daily Powers: Huh?

The intro module mentions that if a given item has already been used that day, it can't be used again by anyone until the next day.

If Evil Erik uses the daily power of his Hat of Awesome and then is killed by Garth the Good (who takes Erik's stuff, of course), assuming that Garth has not used any magic item daily power yet, does Garth get to use the daily power of the Hat of Awesome that same day, or does Garth have to wait until the next day?

If the next day Garth uses the daily power of his Hat of Awesome, and then gives the hat to Larissa the Lawful Good, can Larissa use the daily power of the Hat of Awesome that same day (assuming that Larissa has not used any magic item daily power yet)?

The rules say "A magic item's daily power can be used once per day and is renewed when its user takes an extended rest." I interpret that as meaning that anyone using the item expends the power, and if someone else picks it up they need to take a rest to recover the power.

This is supported by an item in KOTS, where the description says "If (former owner) uses this (item's) power during the fight it can't be used again until after an extended rest."

Taken to its logical extreme, this would mean that if a fighter uses his flaming sword's daily power in a fight, and then gets himself killed, someone who finds the sword a hundred years later would have to take a rest to recover the daily power, but I think we can dispense with that piece of nonsense.
