Nonlethal damage qn

Suppose I have a character with 10 hit points. He's taken 5 points of nonlethal damage. Then he cops a critical hit from a greataxe for 20 points of real damage. Is he

1) unconscious, because his nonlethal damage total exceeds his current hit points;

2) dead, because his current hit points are at -10?

Technically, both conditions apply. You just don't notice the unconsciousness, because he's dead.

If some effect brings him back to life at 1 hp, but leaves him with 2 points of nonlethal damage, he'll be alive but unconscious.

Nonlethal damage, being nonlethal, doesn't contribute towards a character dying. PHB v3.5, p146, "Do not deduct the nonlethal damage number from your current hitpoints."

However, he then gets thwacked for 20 points of real damage. 10 - 20 = -10. He's dead, Jim.

If what you meant was "A character with 15 hitpoints who has taken 5 points of nonlethal damage", then he is at -5, and he's not dead yet.
