Thanks, though.Sidethought: Does anyone think that the Ogre mage as a PC is sort of hard to figure out, thematically? All this combat prowess, yet an innate bent for spell casting. Sounds like hexblade, then moving to some sort of spellsword pclass.

In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include -
(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
(2) the nature of the copyrighted work;
(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
(4) the effect of the use upon the potential market for or value of the copyrighted work.
The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors

Fair use is highly misunderstood. People stretch it far too widely. Posting the Savage Species progression for Ogres is not covered by Fair Use unless it is provided for a specific use covered by Title 17, Chapter 1, Section 107. The courts have interpreted fair use broadly, but not as broadly as the people on the internet think.

Regular Ogres don't get Regeneration
And Trolls do.
The Ogre Mage is the best of both worlds. It gets to look like an Ogre
and regenerate like a troll.plus it has its own powers. like polymorph, gaseous form, invisibility, fly, etc...
one of the nastiest uses i first remember when using Ogre Mage was in S2 White Plume Mountain.

I would definitely maintain that looking at a subsection of rules here in the Rules Forum precisely constitutes "criticism, comment... scholarship, or research", per Title 17, Ch. 1, Section 107. The use here easily passes all 4 of the important factors when determining if it is "fair use".
