There was some speculation in another of these threads that the Mark is just a typical arcane mark, and everything about its effect if Belkar breaks the rules is a big bluff.

Also, I think Belkar is reasoning that he didn't do any damage to Vaarsuvius -- the owlbear did. Crown attorneys would no doubt argue that Belkar is using the owlbear as a weapon. However, this issue is unlikely to be settled in court, so all this is hypothetical. Roy would not be bound by such legal technicalities. He's Lawful Good, not Legalistic Good.
