Wouldn't two tormenteds be 40% spell failure?

Also, 6 points is *awfully* high. Perhaps a better solution is to extend duration/healing time, instead of increasing the penalty. After all, there's only so much pain a human(oid) body will report.

Maybe a progression like this?
Pained: (as before, short term only)
Tormented: 2 pained = 1 torment. Penalties as before. Supress to pained with herbs (no further reduction possible), halted with cure light wounds, 1 week bed-rest reduces to pained.
Tortured: 4 pained = 2 tormented = 1 torutured. You suffer a -4 circumstance penalty to each ability score and can take only a move action each round, and a 40% chance to miscast spells with somatic components.
Supress to tormented (no further reduction possible) with herbs, halted by cure serious wounds, 1 month bed-rest reduces to tormented.
Devastated:2 tortureds = 1 devastated. Penalties as tortured. Herbs cannot suppress the pain. 6 months of bed-rest halves the penalties, and a full year of supervising helaing care to a -2 circumstance penalty to Strength and Dexterity with a 10% chance to miscast spells with somatic components, but non-magical healing is impossible. Lesser restoration reduces the condition to tortured, and suppresses all penalties for a week. Heal and the other restoration spells will reduce the condition to pained. Regeneration, Limited Wish, Wish, and Miracle will completely cure the condition.
