You surprised? A few years back pharmaeudical patented the extraction and use of blood from umbilical cord. Something that doesn't come from humans seems even easier to patent.

I just imagine how humanity's developpement would have been slowed if the wheel, the bow and arrow or the hammer had been patented.
If you make a GMO version of those, you'll be able to patent them.Sadly, yes I am surprised. I don't get the logic behind being able to patent an annual or a plant. But hey, maybe they'll be the new way to make money. Patent plants and animals. I call dibs on dogs, can't, and roses.
