I don't really know anything about US Constitutional Law, but isn't the Elastic Clause closer to Rule 0? The ability to make new rules?

The Heavy Crossbow rule isn't about creating new rules. It simply states that a rule is still a rule, even if it's not found where you'd expect it to be, unless explicitly contradicted.
