Old attorney shared story from his family:
My late uncle was known to represent people that others would not, such as a black gentleman accused of simple assault on a white man, who happened to be known as the town bully. My uncle knew that the judge assigned to the case was thoughtful and able to hear what people meant and not just what they said. The defendant was persuaded to skip a jury trial let the judge hear the case. Unsettled by the advice, he finally agreed.
At trial, the bully took the stand and testified that he was simply walking down the street when the defendant approached him out of the blue and punched him. When the judge asked what he had done to provoke the attack, he denied knowing any reason why the defendant would want to hurt him. After other witnesses, the defendant took the stand.
The defendant told the court that he went out of his way to have no dealings with the town bully. On the day in question, the man appeared out of the blue, pushed him against the wall. "Your honor, he called me a black SOB. What would you have done if someone called you a black SOB?"
The judge leaned back in his chair and replied, "Well I'm not black, so it wouldn't happen to me." The defendant wanted the judge to see his point, so he quickly asked, "Well what if someone called you the kind of SOB you are?"
The courtroom immediately went silent. The judge started to open his mouth in reply when a big grin broke out on his face. "I find the defendant not guilty, court is adjourned."
