Teleport grapple - huh?

If your friend (say a fighter) is grappled by a colossal scorpion (grapplye check +73), can you cast Fly and then touch your friend and cast Teleport to free your friend? Does the scorpion get a save? Do you have to succeed at a grapple check to save your friend? Thanks.

Sure you can teleport someone that is grappled but personally I would require a touch attack with a few modifiers added in to "hit" the person that is being grappled.

Why would the scorpion get a save?

Sounds like a touch attack to me; and since the victim is assumed to be struggling, he should use his full touch AC. If he decides to hold still for an easier touch, then I'd give the scorpion an AoO against him. That's just me though...

On the other hand, if the scorpion took the -20 on his grapple check to keep the vicitim in one pincer, then that sounds more like trying to hit an attended item.

Seems like the hang-up is

from the SRD
Saving Throw: None and Will negates (object)
Spell Resistance: No and Yes (object)

Only objects held or in use (attended) by another person receive saving throws and SR.

But I'd say that a PC, with very few exceptions, is not an object. I'd also probably require the melee touch.
