Because it received mediocre results (and deservedly so, imo) in the previous poll and did not qualify for this one. Not that I think several of the books should be on the current list as several other book that were not top finishers in their categories still received higher percentages in their respective polls than some of top finishers did in theirs.

Tome of Battle did not do that well. Alll the ones in the OP under "Core Rules" (and, actually, all the ones in the OP) did better.

This list doesn't quite sync up with my personal vibe the way the third party D20 list does. The final 10 not including XPH. And though it didn't make the top 10, the vote was way too kind to Complete Warrior AFAIAC.
