Simple, moritheil: Living Spells are mindless. They have no skills, and wouldn't use the Move Silently skill, since that implies planning.

The DC to hear a Living Spell would have a set DC -- determined by the DM -- like those listed under the Listen skill description.

You mean I can't just by-pass the original question? ;)

Keep in mind that a Living Silence is a creature first, and a spell effect second. Although it has 2 special attacks (Spell Effect and Engulf) which would cause the silence effect, it is not necessarily silent itself. It's a ooze, after all.

It makes the same sounds ooze makes. It's just that it's victim's screams might be silenced.
