Using wands above your level.... help.

The question is quite simple...

Can a 1st level wizard use a Wand that casts a spell beyond his level.


Can a 1st level wizard who knows Magic Missle use a wand that casts the spell at 9th level of effectiveness?

Yes, the only requirement for wands is that the spell is on your class' spell list (you don't need it in your book or selected as a sorceror/bard) or you can make a UMD check at DC 20. No stat or level requirements.

The balance is that it is a costly resource that should be beyond the means of a 1st level character.

Indeed you can as others have said. Just wanted to point out that if you were a cleric with the Magic domain, you could use wands without penalty from both the cleric and wizard/sorceror spell lists!

I have a player in my current game who is a cleric of death and magic. I freaked out one time when I looked at her character sheet and saw a wand of magic missile and a wand of lightning bolts.
me, "Why did you put this on your sheet?"
her, "you told me to"
me, "what was I on that night?" (just a figure of speech, in case you, or eric's grandma, cares)

Eventually I rembered she could use them due to the domain, but it was a funny exchange.

Oh, and now in the same game I have a warlock with UMD maxxed out. With deceive item, he has an automatic check of 25, even though he only has 6 warlock levels.
