Oh, and just to be clear, Scott Bizar hasn't been engaged in any of this back and forth, he's been pretty quiet through out it all, and most of the arguing for the MHG side of the house has also been by the fans/supporters. Jack's pretty much kept mum, and other than Jeff making some comments here and there, he's been keeping clear of the flame wars lately.

For now, I'm content to sit back and let the courts decide who's got a valid claim, though I'd still prefer that all parties involved could come to some sort of agreement, as I've had dealings with all of them, and don't want to see either company take a finical loss.

And, unfortunately, Jeff has stated it is going to be a marathon. In his opinion, if Monkey House wins the trademark, Scott will appeal and, if, by some chance Scott wins, Jeff and Jack will appeal or just release the game under another name.

At the least, Jeff, stated here that Monkey House would welcome Scott publishing under MHG's license and even supply compatibility stickers for his printed stock. That is, at the least, a small glimmer of light. However, I don't see Scott relenting and this is probably not going to be a pretty battle.

It hasn't been pretty up to this point, and it's driven away some long time players, and guys who were thinking about coming back to the game. That's the unfortunate side effect of all this bickering.

I haven't really followed it other than the Ain't It cool news and V&V Forum thread. Has there been anyone other than Alabaster Knight (James Bishop (?)) who was truly uncivil?

There's a couple of threads floating around on Critical Fumble, and the two Yahoo V&V Groups that make for "interesting" reading, if you want to read through several pages of arguing, finger pointing, and name calling. IMO, the best thing to do is just stay out of it, pick up products you like, and let the courts do their job.
