What's an example of a circumstance penalty?

An example would be :

Player : "My paladin with 15 ranks in diplomacy and 20 cha wants to charm the serving wench."

DM : "You havent bathed in 3 days and am covered with the blood of a hundred orcs. Yous till want to do that?"

Player: Of course! Sure I'm covered in blood and grit, but with my skills and charisma, I make it look sexy!

Ah, in my haste to post a joke I misread this topic...

How about "flirting with DM's boyfriend/girlfriend/spouse/smizmar: -2 to everything per glance or friendly word (stacks).

Penalties in 3.5 are supposed to be unnamed :) Some of them slipped through with names, though.
Do you have a general rule to state that the penalties are supposed to be unnamed?

Yes, actually.
Glossary said:
penalty
A negative modifier to a die roll. Penalties do not usually have a type, and always stack with other penalties (except those from the same source) unless otherwise stated.

"Some of them slipped through with names, though" is a statement that doesn't mesh with the Glossary definition.
