In Sandstorm, the sulfur mephit has the summon mephit ability listed for it, similar to the mephits in the MM. But then it goes on to state that the summoned mephit only stays for three rounds, even though the summoned mephit can't do any summoning of its own for one hour.
Both the MM and Sandstorm say to treat the ability as a 2nd level spell. I always thought that this was only for dispelling purposes, not duration. But Sandstorm is implying that the mephit's caster level is the minimum level to cast the spell, thus it lasts only three rounds. There is nothing in any of the 3.5 monster books to contradict this assumption, as far as I can tell.
Now extend this to the baatezu's (devil) summoning ability. The 3.5 MM doesn't elaborate on the fact that the devil is beholden to the summoner and only uses the ability as a last resort. Nor does it say that the summoned devil stays for 1 hour. It only says to treat the spell as a X level spell and doesn't specify the caster level.
The lastest published book to describe the devil's summoning ability the "old" way is the BoVD, which is 3.0. Did something change with 3.5?
