Anthoiny Valterra was trying to rush it into production in 2003 because he knew the d20 STL was changing and wanted it to still be d20 stamped; however, if I recall correctly, it was OGL, just not d20-stamped.

I'd say that the BoEF looks more like work of 6th graders who desperately want to show the world how grown-up they are. To generalize, I would say that the need to strenuously separate the 'mature' from the 'immature' is one of the hallmarks of adolescence.
