Not that I'm not sympathetic to your argument, but the entire problem stems from a difference in vision concerning how this spell was meant to be used. Telling someone to obey intent is, IME, unlikely to help.

(I say this having had to deal with players who lament the fact that they can't create water inside peoples' brains anymore . . . IOW, people for whom the enjoyment of DnD comes from wreaking havoc with the system, not playing it in a straightforward or "gentlemanly" fashion.)

I think Moritheil is correct in this case. A player who is using a spell in such a fashion will probably not consider that a worthy reason. Meanwhile, I do believe that the DMG goes into players creating unique situations and how to resolve them. I remember it saying something about adding saves were appropriate and then goes on to describe what each save represents.
