Understandably so. Regardless, I see no reason not to believe Olivia.

As I said earlier, people who did nothing have lost everything because of false accusations, even if it was later PROVEN, that they indeed did nothing (e.g. Jörg Kachelmann).

So while I don't see any reason not to believe her, there is still the concept: "innocent until proven otherwise", and rightly so.

There are enough people in prison (or sentenced to death or shot by police) who were innocent.

In the absence of hard evidence, we have only Hill’s word and Mearls’. And as far as I know, Mearls has never even denied Hill’s claims. I see no reason not to believe Hill.

To be honest, what would denying do him good? It would just attract more anger towards him. As seen often enough, once the public has made up their mind every word except for a full confession is not enough. Even if they were innocent, which might be hard to prove.

In the middle ages witches were totured until they did confess...

So the only way to get out is full withdrawal fromm social media.

EDIT: Back on topic, Mearls' situation is a great example of why you should background everyone you go into business with, even if it's just a 15-minute Google search.

Don't rely on "he's always been cool with me," as lots of racial and gender-based issues may not show up in situations where it's two straight white dudes speaking with each other.

See if there are other things out there about the person that you might not want linked to your company or to you.

If you have more than 15 minutes, send some emails to a diverse group of people who might have broader contacts than you do.

It only seems like a pointless hassle until it saves your ass.

I don't think anyone is suggesting Mike Mearls goes to jail

Innocent until proven guilty is a legal concept. And an important one! As you rightly observe, to not presume innocence in court could easily lead to a lot of false imprisonment. And if this matter was being litigated in a court of law, I would wholeheartedly agree that there is not sufficient evidence to merit a conviction. But since there is no legal action being taken, there is no need for such a standard of evidence. The question is not “should Mike Mearls go to jail?” it’s “do you think Olivia Hill lied about Mike Mearls passing personally identifying information on to Zak S?” And for me, the answer is a clear and resounding no. I believe Olivia Hill.

This is a legal concept (and a burdonesome one, right so) which protects individuals from arbitrary prosecution and imprisonment by the state. It has literally nothing to do with ordinary people having conversations about people, or with people moving to the MtG department in the company they work for.

To my knowledge, Mearls has not been prosecuted and imprisoned by the state for anything.

This silly soundbyte needs to die a death, as it's raised every time anybody criticises somebody on the internet. That's not what it means.

And if you really want legal standards of criminal proof applied to ordinary conversation... well, I don't envy your social life! But you could set an example - how about you provide evidence beyond a reasonable doubt of everything you say from now on? Do you feel that it's reasonable to apply burdonsome legal burdens of criminal proof to everyday conversation? Perhaps we should have 12 peers vet your every post from now on? Just to be sure. :)

OK, I'm being silly, But you get the point. The rules in a courtroom apply only in a courtroom.

Now if you want to reply, I'll need you to file a motion.

Remaining silent on the matter was probably the best course of action he could have taken. But there is no need to prove his innocence because no legal action is being taken against him (and if there was, it would likely be his guilt that needed proving). This is entirely a social issue.

Yes, and that was an unethical practice. Fortunately, that isn’t happening here.
