WotC Talks OGL... Again! Draft Coming Jan 20th With Feedback Survey; v1 De-Auth Still On

Following last week's partial walk-back on the upcoming Open Game Licence terms, WotC has posted another update about the way forward.

The new update begins with another apology and a promise to be more transparent. To that end, WotC proposes to release the draft of the new OGL this week, with a two-week survey feedback period following it.


They also list a number of points of clarity --
  • Videos, accessories, VTT content, DMs Guild will not be affected by the new license, none of which is related to the OGL
  • The royalties and ownership rights clauses are, as previously noted, going away
OGL v1 Still Being 'De-Authorized'
However, OGL v1.0a still looks like it's being de-authorized. As with the previous announcement, that specific term is carefully avoided, and like that announcement it states that previously published OGL v1 content will continue to be valid; however it notably doesn't mention that the OGL v1 can be used for content going forward, which is a de-authorization.

The phrase used is "Nothing will impact any content you have published under OGL 1.0a. That will always be licensed under OGL 1.0a." -- as noted, this does not make any mention of future content. If you can't publish future content under OGL 1.0a, then it has been de-authorized. The architect of the OGL, Ryan Dancey, along with WotC itself at the time, clearly indicated that the license could not be revoked or de-authorized.

While the royalty and ownership clauses were, indeed, important to OGL content creators and publishers such as myself and many others, it is also very important not to let that overshadow the main goal: the OGL v1.0a.

Per Ryan Dancey in response this announcement: "They must not. They can only stop the bleeding by making a clear and simple statement that they cannot and will not deauthorize or revoke v1.0a".


Amend At-Will
Also not mentioned is the leaked draft's ability to be amended at-will by WotC. An agreement which can be unilaterally changed in any way by one party is not an agreement, it's a blank cheque. They could simply add the royalties or ownership clauses back in at any time, or add even more onerous clauses.

All-in-all this is mainly just a rephrasing of last week's announcement addressing some of the tonal criticisms widely made about it. However, it will be interesting to see the new draft later this week. I would encourage people to take the feedback survey and clearly indicate that the OGL v1.0a must be left intact.

I would love to see the wording of a lawsuit based on no direct action... "They said they were going to" and "We have leakers showing they might" and "They give off the vibes of"

becareful what you wish for... what happens if that legal ruleing comes down on the side of WotC?

If we have millions of gamers willing to raise that money I guess WotC is right... the customer base has a TON of disposable income (not me) that is under monitized... maybe everyone NOT in my group can throw $30 a month and not blink...
how amny $30 bakers to get to a million you ask, lets find out... just over 33,000 but remember that's a million a month we don't need that (even though 4e was half way there) so divide by 12 and we get 2,750ish...

So I wonder if those same 3,000 (rounding up) people just said "if we sign up for your $30 a month program for 3 years will you make it irrevocable" if that would be a better use for this...

If the ruling came down for WOTC it would still be better. Heck I wish OGL 1.0a had never happened in the first place.
It was bad for the hobby! That is the point our hobby got distorted into what it is today. Our hobby used to have hundreds of rpg's based on imaginative and truly unique ideas. Then WOTC conquered everyone by opening up their rule set so EVERYONE could abandon their own ideas and come feast on the OGL.

This was never a good idea for the hobby itself or even WOTC in the long run. It's like in all those horror sci fi movies and TV shows where cloning takes over and the same exact people rule forever without changing. Things stagnate, new paths are resisted, and decay starts eating out the center.

We want D&D forced to battle other rpg's in an ever-evolving fray. Survival of the fittest! Only in this way will the game change to meet our needs.

That doesn't mean that WOTC shouldn't be held to the contract it made with us though. They reaped the benefits for decades and people spent decades pouring their blood, sweat and tears into building a business on the foundation of that contract.

Even though it would be better for the Hobby in the long term doesn't mean that would be a easy pill to swallow for all those people without a job or with failed businesses.

Either way though, my hope is the way things have been done for decades now is over. The safety of staying under WOTC's umbrella has been revealed to be less than ideal. Now, finally we should begin to see growth again and new attempts at something better.

You always could publish for those other systems, as long as you dont use Product Identity or any of the specific phrasing that is in any WotC (or any other companies!) copyrighted material. Probably the best discussion of it that I have seen in my (limited) trawling of the youtubes:
yeah, that is a minefield even worse than going to court over 1.0a, so no, not really an option - and I have seen that video and others, he is oversimplifying

I don't understand people that think, that everything big corporations do is screwing you over to get your money.

I guess the truth is in the middle.

They try to get money by producing something you like. And you actually get what you like bevause someone has the interest of actually inventing those...

Here in Germany we have seen the difference between capitalizm and communism. Guess where people got more of the things they wanted...

I for my part hate what WotC are doing. But I am grateful that D&D is thriving because for the last 10 years, WotC have done a quite good job as stewards of the game.
I hope this all settles down with a good, irrevocable OGL 1.2 or 2.1 or whatever that makes it a safe haven again.
Nah, they try to fet your money giving you the less they cam for the more you can spend.

WotC has certainly benefitted immensely from it, that they now want to get away from it is idiotic

As to the hobby, there are more games now than ever, more players than ever, more products than ever, so hardly a problem either.

I know you will say something along the lines of

Things stagnate, new paths are resisted
but I am not sure that is even true. There are still plenty of RPGs that are not simply 1st gen OSR or 5e-alike (PbtA, SW, SotDD, …). I have no numbers but I assume they are not actually selling worse than 20 years ago, it’s just that D&D grew so much thanks to the OGL. So no downside here either, just not as much of an upside
