D&D 3E/3.5 [3.5] Elixir Confusion

This may have been addressed previously, but I don't recall seeing it.

Why are elixirs under Wondrous items?
Is this a mistake?
Can they be built using the potion creation rules?
Has this matter been addressed by WOTC?

If I recall correctly, Elixirs are consumable magic liquids whose effects do NOT duplicate a spell. For example, potions are merely "spells in liquid form". You drink the potion and get the spell effect. But Elixirs do not duplicate a spell effect exactly. For example, there is no spell that gives +10 to Search skills like the Elixir of Vision does.

Also, not all Elixirs use a spell of 3rd level or less. If in your own game you want a liquid form of a spell over lvl 3, make it an Elixir.
