D&D 3E/3.5 3.5 swarm question

Using the new swarm type from the 3.5 MM:

Suppose you have a swarm composed of Tiny creatures, so it can be attacked by weapons. If the swarm is attacking (in the same square with) an ally, can you attack the swarm without hitting the ally?

Also, can "weapon-like" spells (such as ray of frost) be used against a swarm?

I didn't find anything in the rules saying there would be any risk hitting your ally.

Also, can "weapon-like" spells (such as ray of frost) be used against a swarm?

"A swarm is immune to any spell or effect that targets a specific number of creatures (including single-target spells such as disintegrate), with the exception of mind-affecting effects (charms, compulsions, phantasms, patterns, and morale effects) if the swarm has an Intelligence score and a hive mind. A swarm takes half again as much damage (+50%) from spells or effects that affect an area, such as splash weapons and many evocation spells." [3.5 MM page 316]

Just dont forget that swarms composed of Tiny creatures take 1/2 damage from piercing or slashing weapons. Those composed of Fine or Diminutive are immune to all weapon damage.
