Not to sound flippant (not my intent), but I'd suggest asking a lawyer and not the internet.And what if I'm not using either the OGL or the SRD, since I'm publishing commentary under fair use? I've been advised in the past not to include illustrations of monsters that WotC claims as product identity. Having an explicit list of what those are is helpful.
To assume—or to assert—that every creature in the MM25 that's not in the SRD is product identity is unreasonably overbroad. But at the same time, it would be foolish to think there aren't some creatures in the MM25 (probably, for instance, the Blob of Annihilation) that WotC does consider product identity.
