2024 only released via the CC BY, so the designation of product identity no longer matters. It's either in the SRD or it's not.

But also, it's mostly the same as 2014 for which monsters exist.

There isn't a 2014 OGL, just the OGL v1.0a published in 2000. It is still a valid license for content which was originally released under it.

If you are using the OGL, then the list of Product Identity is found in the relevant SRDs (3.x, 5.1, Pathfinder Reference Document, A5ESRD, etc.) you are using.

If you are using the 2024 SRD, you are not using the OGL, as it was released under Creative Commons instead. That license has no concept of Product Identity. You can use what's in the 5.2 SRD.

And what if I'm not using either the OGL or the SRD, since I'm publishing commentary under fair use? I've been advised in the past not to include illustrations of monsters that WotC claims as product identity. Having an explicit list of what those are is helpful.

To assume—or to assert—that every creature in the MM25 that's not in the SRD is product identity is unreasonably overbroad. But at the same time, it would be foolish to think there aren't some creatures in the MM25 (probably, for instance, the Blob of Annihilation) that WotC does consider product identity.

Naturally. But first I want to have something in writing that I can direct my lawyer's attention to. I'm asking my lawyer for the legal advice; I'm asking the Internet for a list I can show to the lawyer.

I would think the answer is in two parts. This is a list I found, but don't know how updated it is:

Part 1: Anything created by TSR/WotC is protected IP.
Part 2: Anything not created by TSR/WotC (like Banshee or Yeti) is not protected IP unless you're using copyrighted illustrations or text (presentation).

Of course I'm not a lawyer, so take this with appropriate grain of salt.
