Concentrating while sneaking?

Quick question about DCs...

Tonight, I was trying to sneak up on a guard while keeping him drowsy under a lullaby spell. Some difficulties occurred.

The spell's duration is "concentration +1 round/level". So, I was trying to keep up the spell while sneaking up to the guard to knock him out. What kind of concentration check must be made in such a situation? There surely must be a check, to concentrate while hiding and moving silently. But with no other distractions, what would be an appropriate DC for the check?

Concentrating on a spell with duration: Concentration is a standard action that does not provoke attacks of opportunity.

Hiding and moving silently are part of a movement action.

All that means: you can concentrate on a spell while sneaking, but you can just move a simple move at half speed while doing so.

So is a concentration check necessary? What's the DC?

I would say no concentration check... just upkeep. It's a standard action that might be interrupted, not more and not less.

Do I mess it up or does "concentrating on a spell" now provokes AoO (in 3.5) ?!?
I would bet I read it today somewhere ...
