Does being raised affect a wizard's spell aquisition?

Hi, all.

My wizzie ended up getting dead last week; the current plan is to keep him Gentle Reposed until we can get back to town. The raising should drop him back from 9th to 8th level, which brings me to my question. When he levels back up to 9th, do I again get to pick two spells of levels 5 or below, or am I already considered to have aquired them? Seems a bit much to be able to get two new spells all over again. Thanks!

Only if he retroactively lost the two spells gained due to levelling up to 8th. ;)
If you have a spellbook that erases the "free" spells automatically each time you die or lose a level permanently, then "yes".
If you have a "normal" spellbook, you shouldn't gain "free" spells anew.

By RAW you do not lose the spells from your spellbook, and could chose two different spells when you level up again. If you lose acess to a level of spells (when you die on odd levels), you do un-learn the spells. They arn't removed from your spellbook, but you do need to make a spellcraft check to learn them which is not nessesary for automatic spells and is frequently ignored for scribing new spells because the DC is low enough you can take 10 if you have at least half ranks in spellcraft.

But as mentioned, it's not a popular ruling.

The interpretation lies in what you think "new" means. Here's the SRD text:

At each new wizard level, she gains two new spells of any spell level or levels that she can cast (based on her new wizard level) for her spellbook.
Although the PC has "been" to this level before, it still is a new level; the PC had to earn all of the XP to get there, and the level had to be added to his character sheet, with all of the choices that makes.

After all, you get to distribute skill points and make a feat choice. Those choices do NOT have to be the same as the "last time you went through". ;) You have to roll up new hp, etc.

It's a new level; your PC gets 2 new spells.
 


I believe TheGogmagog has the most correct answer for this question. You are entitled to learn and put new spells into your book when you gain your level, but you run a chance of not being able to learn spells that are already in your book if you fail the learn DC for those spells. If you want to guarantee that you know the spells you previously put in your book, you have to choose them as the spells you gain for leveling.

Most wizards would probably take the chance to research new spells for free with the possibility of delayed aquistion of the spells that are already entered into the book.

So......what about those spells you may have found/bought/stolen and then scribed into your spellbook during that level....the level that you lost during the raise dead? With your interpretation you would lose those too, right?
 

I originally thought "I wouldn't take away the old spells and I wouldn't give him new ones" but on thinking about it further, I consider the spells gained to be the result of work and research during the process of gaining the level, so I'd allow him gain two new ones when he reaches 9th again. He'll have extra spells in his spell book but he's a level behind and probably needs all the help he can get!
