It merely states "If the character fails this check, she cannot drink the potion." A literall intepretation would mean that you simply fail to drink it. I believe this is the intent as well.
 






Does it really make any sense for one potion to be harder to drink than another? It would make more sense for it just to be DC 10 + the damage dealt.

There is no spell level with drinking a potion. Now if you fail by more than 5, maybe you should lose the potion.

No, it doesn't make any sense. But there certainly is a spell level for (at least most) potions - the level of the spell contained in the potion.

Spell level is for the spell being cast. The spell has already been cast, the question is, is this an oversite or is the intention to have more powerful potions harder to drink?
