Ebay question

Ok, this doesn't have anything to do with D&D, but I figured someone on here (my favorite internet stomping ground) might have encountered this kind of thing before and would have some advice.

My wife bought a "Kate Spade" purse on Ebay a couple of weeks ago.

Now, Kate Spade purses are, for those that don't know, somewhat expensive purses that are often counterfeited. Now, my wife actually bought two on Ebay - from different sellers. A black one, and a brown one. The "Kate Spade" label on the brown one was slightly different, was glued on "as opposed to sewed on", and the font size was slightly larger than the black one. My wife went to Nordstrom and asked the clerk about the bag, and the clerk told her that the fake ones fit the description that she described.

So, basically, the brown bag was fake, and the black bag was real.

So, my wife didn't want the brown bag. It was illegal first off, and should never have been sold on Ebay. Ebay specifically looks for these kinds of things and removes them.

So, I emailed her:

"My wife has indicated that the Kate Spade purse is fake. The tag on the
outside is glued on, and the lettering is larger, and not consistent
with real Kate Spade purses. My wife asks that you refund her purchase,
and we will ship the purchase back to you. Please reply."

And this was her response:
"I did not advertise it as being real. But if you like I will refund her
money less my listing fee and shipping.
thanks "

So, my question is, has anybody encountered a situation like this, and whether anyone here knows what Ebay's policies are in such situations? I would check their site, but ebay.com is blocked from my workplace.

Sorry, I don't know what advice to give you. If she advertised it as a "Kate Spade" purse, she can't argue that she never advertised it as such. That's a scam and she should be reported to eBay.

Post your question at the Answer Center on the eBay site. There are a lot of volunteers there who can help with the specifics.

I actually enjoy reading the comments there. Some of the scams people try to pull are amazing. There was one very scary one in which someone's account was hijacked and used to sell nonexistant cars. :eek:

Oh, and one last thing, be sure you keep any e-mails that she sent you. You may have to forward them on to whomever at eBay handles such things.
 

Did she advertise them as being fake? If not, show no mercy. I would rather not buy a Rolex from ebay only to find out it was fake, and that it was common practice to sell items without informing it was indeed not a real Rolex.
 

P - there was nothing indicating that it wasn't a real bag. First off, that would violate Ebay's policies, and secondly my wife wouldn't have bid on it.
