Enslave Outsider/Elemental Spell

Here's a new spell I made based on Sean K Reynold's article on binding "Gingwatzim" (ethereal air elementals) in the LGJ of Dragon #295. Feedback, please. Too powerful?

I've made four versions of the spell: one for summoning up to CR 2 creatures (3rd level spell), one for summoning CR 3-4 creatures (4th level spell), one for summoning CR 5-6 creatures (5th level spell) and one for summoning CR 7-8 creatures (6th level spell).

UPDATE: Changed limit of creature power from HD to CR.

Minor Polymorphic Planar Slave

You lure a random representative of a type and/or subtype specified by you at time of
casting into a specially prepared magic trap, where you seek to force it into your service.
The creature's spell resistance does not apply but it receives a Will save to refuse the
summons. If you know the
true name of a specific creature, you can call it instead.

When you call a planar creature, you can force it into one of three forms which must be
chosen at time of casting and cannot be altered later unless you dismiss the creature and
successfully call it again. The three forms are: 1) its natural form on its home plane; 2) an
animal, fey, humanoid or plant form with an appearance of your choosing and of the same
size or smaller than its natural size; or 3) an object of the same size or smaller than its
natural size, such as a weapon, suit of armor, shield, amulet, wand, rod or staff. Creatures bound
into objects lose all ability to move and all other abilities except spell-like abilities and
telepathy (if any).

Creatures bound into a form not their own have any non-armor bonuses to AC become
natural armor bonuses. They retain their normal, extrardinary, spell-like and supernatural
abilities and forms of speech and movement unless these are not provided by the new form
(such as a succubus bound into a human female being unable to fly as her new form has no
wings). Creatures are typically bound into physical forms not their own because their
natural form is too unpleasant or dangerous, or the master wishes to conceal their true
nature from others.

Once the creature appears, it is trapped by the magic circle and you must either force
it into service (opposed Charisma check applies) or else bargain with it until some
mutually agreeable arrangement can be made or you decide to dismiss it (opposed Charisma checks apply). Each day it is trapped,
you can force another opposed Charisma check upon it until either it escapes, accepts or you dismiss it.
Trapped creatures receive one escape attempt each day they are held prisoner as per
lesser planar binding.

You can only have a number of CR worth of planar slaves equal to your spellcasting level.
If you attempt to exceed this limit, it frees all preexisting slaves immediately, though this
does not interfere with your attempt to gain a new one at the time you exceed the limit.

Planar slaves gain XP as any normal follower would (a half share), and if this increases their HD and/or character level, their new level counts against the total number of HD of planar slaves you can control at any one time.

Planar slaves may be dismissed back to their native plane as any elemental or outsider can; in addition, if they are hit by a targeted dispel magic spell,
they are immediately dismissed without a saving throw.

Special: This spell requires you to precast a magic circle spell of the appropriate type
(focused inward) to use as both a focus and trap.

Using this spell to call a creature with one or more subtypes (such as air, chaotic, earth,
evil, fire, good, lawful, water, etc.) makes it a spell of that type. Thus, calling a lemure up
would add both the lawful and evil descriptors to the spell.

Creature Types, Sizes and Temperaments:


up to CR 2 (Small): Content, docile, lazy, or stupid, such lowly creatures only receive a save
to escape your control once per week, and even then at a -2 penalty.

CR 3-4 (Medium): Aggressive, alert and willful, these creatures are beginning to manifest
signs of their true power and will rebel if not allowed to slake their thirst for battle, cruelty
or murder at least once per week on one or more sentient beings. They receive a save to
escape your control once per week, but receive a +2 cumulative circumstance bonus for
each week that passes where they are not able to satisfy their baser instincts.

CR 5-6 (Large): These creatures are clever, cunning and resent servitude, subtly twisting
things to their advantage, interpreting the letter of your orders rather than the spirit, and
studying you for the first sign of weakness so they can escape and gain their revenge. They
are allowed a save to escape control once each week. If you have shown any sign of
weakness (according to their kind) during the past week, they receive a +4 cumulative
circumstance bonus to break free per such show of weakness.

CR 7-8 (Large): Hateful, spiteful and utterly malicious, these creatures are always looking
for a way to work towards your destruction in the most spectacular way possible. They
receive a save each day to escape control with a +4 circumstance bonus because they hate
serving you so much.

The article in question in Dragon 295 basically said you could use a summon monster II spell to get a 1-2 HD elemental, summon monster III to get a 3-4 HD elemental, summon monster IV to get a 5-6 HD elemental and summon monster V to get a 7-8 HD elemental, though the article resticted it to a particular race of ethereal air elementals called gingwatzim offering similar benefits. I'm trying to expand on this, to allow for slightly different object forms and powers and of course, to broaden the scope of what kind of creature you can bind.

I'd talked to Sean K Reynolds about his article and he said they forgot to print his spell, Polymorphic Ethereal Slave, in the issue and that it was a 7th level Sor/Wiz spell. However, I think that's too high and am using the summon monster criteria in the published article instead to flesh this concept out.

Should it be made into separate spells (2nd, 3rd, 4th, 5th) , rather than be a single 2nd level spell scalable with level?
 






Revised Lesser Planar Polymorphic Slave bound creature benefits so you don't get to pick armor or shield forms unless binding a 3-4 HD creature. Clarified that any skill(s) modified by the wondrous item must be known by the creature, and these if more than one bonus is given, both skills must be related. Deleted original version of the spell in favor of the two versions posted above.

Totally revised the spells into four different ones, levels 3-6. I think they're much more balanced now vs. the various planar bindings or planar ally spells. Increased casting time to 1 hour per target creature HD as well. Made it easier to dispel them too (no save to resist). Thus, they could be zapped away by enemy casters aware of their planar nature.

Removed ability of slaves to increase HD with master's leveling, though I would think they could still gain XP as any normal follower (a half share) would, and if this increases their HD and/or character level, their new level counts against their master's control limit.
