Epic Spell Creation: Permanent vs. Instantaneous

"Instantaneous: The spell energy comes and goes the instant the spell is cast, though the consequences of the spell might be long-lasting. For example, a cure light wounds spell lasts only an instant, but the healing it bestows never runs out or goes away.
"Permanent: The energy remains as long as the effect does. This meanst the spell is vulnerable to dispel magic. Example: secret word."

The differences between these two things is very distinct and very important. The epic level rules though seem to be a little vague. First of all there is no factor for making a spell instantaneous, either all of its component seeds are, or it may not be instantaneous, or perhaps an ad hoc ruling is meant for each spell. However if you look through the premade spells section such spells as Create Living Vault and Enslave have listed durations of Instantaneous and have gained it via the x5 spellcraft DC permanent duration factor. Then we have Origin of Species: Achaierai which has a duration of permanent which raises of questions of its own. For instance if your trying to play god, and you create two to breed and start the race, can you dispel the offspring? If the x5 factor can be used to make a spell instantaneous as in the above examples why was this not used instead, as it gets rid of some hard questions. So I guess what it comes down to is this, are Create Living Vault and Enslave errors, or are they a correct usage of a poorly worded factor. If they are incorrect (which as far as I can tell from whats written they probably are) how should adding an instantaneous duration be handled, the same as permanent, or perhaps x6, or does it need to be ad hoc for each individual spell.

I noticed the same thing.

Instantaneous is much more powerful but it looks like they want the cost to be the same.

I really don't know why you would choose Permanent. I think it was just overlooked.

I would have to say you should use x6 or x7 for Instantaneous durations.

I think this is going to have to fall under the guise of 'DM judgement'. A character who makes himself immune to magical effects, and then proceeds to give himself -instantanious- (versus 'permenant') DR x/- is clearly out of line (what can hurt him then, short of Divine Blast?).

Mostly, certain things should obviously have an 'instantanious' duration from the start (origin of the species)... But beyond that, by situation I could rule anywhare from x2 to x10 or more for challenging the power of gods.
