They could be using the d20 system, but not the logo and d20 logo license. If I'm correct, that means they basically get to use D&D rules, but include their own character creation and experience rules. That's something you can't do if you use the OGL and d20 logo.

Exactly, it's still a D20 based system but without the D20 license. So, no D20 logo for them (or anything else that the D20 license brings).

You don't even need different wording. You can take the D20 SRD and release it *verbatim* if you wish. That's what it's for.

But why bother? You won't have a lower price point than WOTC can afford. You won't have better writers or artists. You won't have their marketing budget to get your game noticed. You might as well just burn your money in the fireplace and save yourself some time.

Unless you're White Wolf. Them being the #2 games studio in the industry means this will be able to have some significant talent on it.

You're receiving this e-mail because you signed up to hear more about the EverQuest Role-Playing Game on our www.EQrpg.com site.

In just over a week, we will be running a final playtest of the Player's Handbook content of this game and I would like to invite a limited number of people to help us fine-tune this game. If you are interested please follow the instructions below.

1. Reply to this e-mail, but replace the list address with my e-mail address: sword@swordsorcery.com
Do not change the Subject line of your response or you will screw up my e-mail program mail rules for sorting the replies.

2. Describe briefly your qualifications for playtesting including what level of experience you have with EverQuest online, with Dungeons & Dragons 3rd edition rules, and with beta-testing or playtesting other products. We are specifically seeking playtesters who know both EQ and D&D and also playtesters who only know one or the other but not both, so please just be honest in your responses since a lack of experience is equally useful to us as 160 days /played.

3. The playtest will run from about April 10th to April 24th. That's not a heck of a lot of time so please describe briefly how much time you will commit to playtesting and how many friends you will be able to rope in to helping you.

4. Provide your name, e-mail address, snail mail address, and phone number.

That's it. We will also be offering playtesters a few rewards for their help and we must limit the number of playtesters that we will take on, so please reply as soon as possible. If you do not hear back from me, it means we filled the slots and my apologies in advance for not giving you a reply.

Also, we will be demonstrating the game at the Seattle EQ Fan Faire, those of you attending please look for us there!

I think you're underestimating the size of the RPG hobby. WOTC did a survey a few years ago of the RPG market in the US. According to that survey, there are over 2 million people who play RPGs at least monthly (and 66% of those later answered that they play D&D at least monthly) - and I doubt that the number has decreased with the release of 3e. A number that's been mentioned earlier in this thread is 400,000 accounts for EverQuest.

I'm attaching the survey results to this post so you can check the rest of the figures yourself.
