Flank & Improved Invisibility ?

Here's a question for you guys...

A Rogue has Improved Invisibility cast on him before the fight begins. He moves into a flank position during combat, but as he's Improved Invisible he can't actuall get the flank bonus as his opponent isn't aware of him. He will get sneak attack damage on a successful hit because his opponent is unaware of him and thus flat-footed to him.

Now, what if the opponent makes a listen or spot check on the invisible Rogue? He's aware someone's there, just not exactly where, hence the miss chance. Does the Rogue lose his sneak attack damage because the opponent is now aware of him? Does he gain a flank bonus instead?

AFAIK, no and no.

Is it stated anywhere if an invisible character can / cannot flank (assuming his flanking ally cannot see him)?

In the 3.0 FAQ, I believe. I think it got either Artoomis or Hypersmurf all up in arms. :) Can't remember.

I second that. While he knows that someone's there, he doesn't know what that one's doing - the invisible adversary could well have his blade an inch away from his enemy's throat.... So you still get invisibility bonuses and sneak attack.
