True. However, barring Master Alchemists & their special abilities (or similar prestige classes), potions are limited to 3rd level spells.
(Hmm, how unbalancing would a Master of Wands prestige class, with the ability to craft wands with spell beyond 4th level, be?)
On the question at hand -- I can see going either way with it; both approaches seem sensible to me. I think I'd probably fall on the "delays secondary poison effects" side, for balance reasons.
But hey, as a one-time exception, I see nothing wrong with the GM letting a player slide. Magic isn't physics; sometimes, 2+2=The Ninth Name of the Argent Gate, rather than 4. Maybe the character did something in the last week that impressed some god, and said god granted a boon.
