I would say yes. (Basically if its not bought in the open market at a reputable dealer I would say its fair game.)
That is my thought as well. My initial reaction was "Duh, the GM can definitely do this," but then I thought, "Oh wait, its LEW and I've been wrong before so I better ask first."

KO's asking-the-character idea
That idea would be unacceptable in nearly 100% of the cases though, as you pointed out the specifics may merit something else.

BS's stays-in-this-game-only idea
BS never had that idea as far as I know, but even if he did, that one is even weirder. Are you saying that Helena miraculously comes back to life for no reason when Demetrius leaves that one game?

Unless you're currently running a game with Demetrius the Brave.
As the GM, not knowing my power makes me feel a fish out of water, and this is a very bad thing--I really need to know these things in advance...and perhaps I am running a game with Demetrius, but its a secret hidden ninja game!

Nope. She stays dead or undead... ;)

You see, Rystill has ths friend who is running a game where the party defeated an er.... ogre, that adopted this girl, and they want to give the girl a normal life, but the ren... er ogre will be upset if they take her away...

Hey - not mean. Just having some fun. Surely, BS, you remember our short lived 'Remember the Cavaldale' (or whatever) adventure? Several players ended up adopting versions of the DM's garden gnome avatar. I thought it was pretty funny.

As for RA's question RE: Using a PC's background info in a game. Generally, I think PC's backgrounds should be fodder for DMs. Inherently, a player controls one character. The rest is up to the DM. In some cases Players may mark things in their background as private. They should have a good reason for this. Generally, having DMs incorporate PC backgrounds into adventures makes it more fun for everyone, and makes the world more interconnected.

My PC, Percy, does have some private parts to her background. This is for what I would consider a good reason, in that I'm running a series of adventures myself that deal w/some of the NPCs and places in her background. But if other DMs want to use the Public parts, & one already has to some extent, then I'd be thrilled.

Well Clay never really picked that for an avatar... That was Piratecat having fun. :)

I still think my having Crothian’s avatar replaced with Joke Smurf was the best.
