Um. I'm away from my books, and I can't find it in the text of the 3E SRD.

But I thought it was as well... have to look it up when I get home.

I say if Rogue misses Sneak Attack target and hits another target in process that it turns into a plain attack.

I'd rule that way too. It needs special conditions to reach a vital organ, and a normal attack can't randomly become a sneak attack.
