In most of my campaigns, when a party member dies permanently, his share of the party wealth goes to his next of kin. This includes money as well as weaponry, armor, and all personal magic items. If the party wants to keep something specific, they can, as long as they replace it with the fair market value in cash.

In game, this is the honorable (i.e. Good and/or Lawful) thing to do for a deceased comrade. In reality, it's to prevent a party of munchkins from doubling their party wealth by swapping out PCs.

I hate low HP characters as well, although killing yourself is lame. I find characters always want powerful PCs, so I allow them to. I use a 32 point buy and no less than 1/2 HP per lvl. The PC rolls if they roll less than half the dice value, they add half the dice value.

To balance this out, I beef up all of my villans. Once past 1st level, all baddies get max HP, and a combination of bonuses, +1 to AC, Saves, BAB & spell DC's. It makes them tough enough to deal with super PCs. Give the player an extra 10 HP who cares, just remeber to give the enemy an extra 20 :)
