Here's the thing: If you feel compelled to cheat because you're annoyed, and if other players kind of agree and decide to take retaliatory action (even if it's in-game), then there'll be tension at the game table no matter what. But it'll be covert tension. People will be annoyed, feel guilty, etc. And it'll make the game stressful. This tells me a few things
1) The DM was probably expecting you to use stealth/diplomacy/trickery or some other option other than a jail break
2) The DM has a tenous grasp on the ruleset at best and no idea of the CR system.
3) As a group you made no effort to do any investigation as to who might be guarding the jail. A ninth level wizard with Assassin levels would probably be found from a simple gather info check.
4) You did your info gathering and the uber mage guarding the jail didn't come up so the DM is a BOZO.
5) The DM has a tenous grasp on the ruleset at best and no idea of the CR system.
6) A delay poison potion would allow somebody to carry poison darts in their mouth and not worry. (ooh, I might have to have somone do that at some point)
7) In the face of all this you fudged, you feel guilty enough to post, but I bet way down you feel PROVOKED and almost justified. (I'd let it go)
I don't know if the clues were there that breaking in was a bad idea. I'm betting not. I also don't know that you didn't try stealth but "SOMEBODY GOT A FOUR, YOU HEAR ME A GOT A FOUR" on their move silently check and all hades broke loose.
My theory is that the DM is a BOZO with a tenous grasp on the rules and the CR system.

So, especially if you're good friends with each other, put it on the table. Tell your DM that you felt treated unfairly last session, and that you acted in turn by cheating on hit points. Tell him you're sorry and feel bad, but don't hide the fact that you didn't have that much fun by the turn of events.
Maybe the guy will agree. Maybe he's in so much stress that he'd like to play for a while, with someone else DM'ing. Maybe he's in so much stress that he won't listen to reason, and be angry – but if he's a friend, he'll get over it.
You cheated. That's a break of trust. But from what you wrote, the DM didn't seem too trustworthy, either. And you'll have to speak up on both issues to improve the game. Or you can continue cheating, like I did when playing with a certain, really bad DM, who in turn thought everything was swell and I was bored to death.

I have heard from the other players ,who feel the same way that the encounter was way over our heads. I was surprised to find out that one of the players knew what I had done but they choose not to point out my math error which is what he thought it was. He felt that the encounter was unfair and that my character should not have had those magic missles thrown at me the way they were. And he felt my character should not have died because of bad DMing.
We will see what the DM says.
