There is no such restriction in 3.0. One of the examples given on 3.0 DMG p. 246 is upgrading a magic ring.

As soon as I find my list of prices ill post what i would pay for a +2 Flaming Sword

You find out what it costs for a +2 flaming sword (+3 weapon + masterwork weapon cost). Then you subtract what you already have (+1 weapon + masterwork weapon cost).
What's left is what you have to pay to upgrade your +1 sword to a +2 Flaming Sword.

I think this is what you were trying to say LordBOB. But the way you phrased it is confusing.
