D&D 5E Is it just me or does Tiamat kind of blow in Tyranny of Dragons?

A sphinx can teleport every 6th second.

Then they must have changed it from the preview material because there Teleport is a legendary action. That means without combat and enemies the Sphinx can't teleport and even in combat it can't do so in its own turn.

Here is how I read the rules:
Legendary creatures can do more stuff in a round than ordinary creatures; because that is what "legendary" means.
In a round it can move, attack (or more likely multiattack), and possibly take a bonus action and a reaction. And then it takes all it's legendary actions. All this in 6 seconds. Always. No matter if it's not in combat or if it only fighting one opponent.

I see legendary actions as always available; but during combat they are restricted so they can't be used on the creatures own turn, and max one legendary action on each others turn. But it always have access to all it's legendary actions in one round. Because if it didn't had access the creature wouldn't be legendary.

You may read the rules as you want, but for me this is a no-brainer. :)

The rules clearly say it can only use an action on an enemy's turn. This results in legendary creatures slowing down as enemies die or acting slower against small parties. This is no different than how a rogue can run much faster when an enemy is around with Cunning Action than they can when there isn't. Or do you read "can only be used in combat" to mean "can be used even outside of combat" for Cunning Action?

I read it as the DM running it the way it makes sense to him (and possibly his group).

5e Monster Manual p.11 said:
Only one legendary action can be used at a time and only at the end of another creature's turn.

Emphasis mine in the MM quote. It does not have to be an enemy. I think this is why many legendary creatures have minions...

I would actually let my rogue use cunning action utside combat if he could describe a situation where it would be valid.
I would allow the rogue to move 30', open a locked door, then use his cunning action to move additional 30' in one round. I don't understand why he would be in such a hurry outside combat, but I would allow it.
The same goes with the fighters second wind that I allow outside combat.

For me there is no difference between combat and non-combat. Everything you can do in combat you can do outside combat. To not allow it is like a fighter that can't cut down a tree until he rolls initiative and attack the tree. The whole idea of not allowing combat actions outside combat is inconceivable to me. Sorry, but that's how I'm wired.
 

Plus, other creatures ostensibly have turns even when they're not in combat, we just don't bother to track 'em. So when your PC's attack some goblin in some forest half a continent away....SPHINXAPORT! ;)

The rules DO stipulate that the teleport can only be used on another creature's action during combat. Outside of combat, i'd let the sphinx teleport around as much as it needs to. It's only within sight anyway (i think), not continent-hopping teleportation.
 


She is a bit of a handful but doable for a level 20 party. Considering she is CR 30 so shouldn't normally even be fought by a party below level 30, she is pretty under powered. I could see a level 20 party gating her in and kicking her butt for giggles.

How? I have seen people say this but they were wrong.

Also gating won't work as you don't know Tiamat's true name.
