Building on Crothian and Victim... and knowing that this character (at level 40) has money to burn on the unusual (and more expensive) bonuses...
Pure Class Fighter, who put some advances into his Con:
Starting Strength 16. +3 Level (non-epic), +3 Level (epic), +5 Tome of Strength, Strength + Con Bracers +12. One addition of the feat that adds 1 to Strength. That adds up to a 40 Strength.
+30 BAB, +1 Weapon Focus, +2 Epic Weapon Focus, +10 Magic Sword, +15 from Strength, +10 Luck Bonus, +10 Competence Bonus, +10 Insight Bonus, +10 Sacred Bonus, +10 Morale Bonus.
That's not unreasonable for a fighter who is concerned with hitting what he faces in combat. That works out to +108. So you can Power Attack for 25 and only miss on a 5 or lower. Or power attack for 21 and only miss on a 1.
These are EPIC levels. The fighter had darned well better KNOW it's hard to hit things at these levels and plan for it.

On a side note: Druid with a Flame Blade (energy substituted if necessary) will basically always hit (it's a touch attack). Since the spell has a variable, numeric portion (and these are 40th level characters)...
The druid has 4 Bonus Feats and 7 feats from levelling up. So... take one Improved Metamagic and four Improved Spell Capacity feats. That (relatively modest) combination lets you cast an 11x Empowered Flame Blade which does (1d8 + 10) x 5.5 per strike. That's 60 to 99 damage per hit for up to three attacks per round for 40 minutes. This can be made nastier.
Naturally, this approach requires you to punch through SR. If you can't get through the SR, though, you have much bigger problems than how to hit the dragon in melee.
