That's low, Torm. He's your friend. He wouldn't have been angry at being woken at that time for that kind of a reason.

I'm glad you're fine. I hope that you don't have too many "post-accident" health problems. I'm glad all are ok and doing as well as they can for being in an accident.

Got home this evening to find out that the drunk's insurance company called my wife today, harassing her for insurance info (on the van - which isn't ours) and details on injuries. They also told her that he is already out of the hospital, but has no recollection of drinking or driving. And they asked how fast I was going when I "ran the red light". :mad:

I guess I'll be talking to a lawyer tomorrow. I always hope people will go with what's Right in these things, but they almost never do......


Get you a damn good lawyer! Better than your buddy, Tyr! ;)

And find any and all witnesses you can gather to testify on your behalf. Sound like his company's being real snaky, placing the blame on you instead of him. And your wife can tell them not to call her with harassing calls. Tell them not to call her and if they continue to do so, slap them with that too: harassment.

Tell them you were going warp nine and see how they react! :p

I know. :\ I guess it's just the Vulcan in me - if someone can't do anything about a problem, I don't see any point in diverting them from what they are doing. (This very concept was covered in one of the novels about Vulcans as "Mastery of the Unavoidable.") I may mention it as soon as something else provides a pretext for conversation - or on a message board, where the whole point is conversation. ;)
 

Whether our careless friend happens to remember being drunk is completely irrelevant, provided the proper tests were taken at the hospital and all the proper paperwork has been taken care of.

It sounds to me like a standard first volley; not enough to qualify as harrassment, yet an attempt to scare you off or make you second guess your position. Once you have your lawyer and the process starts rolling along, especially with rock-solid evidence, they will start singing a different tune.

Don't get too greedy, but make sure that everyone's medical, property and court expenses are taken care of by the guilty party's insurance company.
 


Speaking of careless individuals, I apologize for not mentioning in my previous post - I am glad to hear that events turned out as well as they did.

I hope after the evidence is shown that his council advises him to stop making baseless accusations in order to save his skin. I have a feeling that when they called your home all they had to go on was his story, which appears to have been more than slightly fabricated.

I'm not playing apologist for the perp, but I know that sometimes you just don't think about it. Last night I had a couple of beers, then thought about how I'd love to drive down to the store and pick up some ice cream. I got as far as standing up and putting the keys in my pocket before going "Doh! What am I thinking?" I sat my butt back down and watched some more TV before going to bed.

Torm, I'm glad you and yours are okay. My grandfather was killed by a drunk driver when I was seventeen.
 

Torm, sorry to hear about all that! Whilest going through Hartsville, my eclipse got tapped in the backend three months after I had it. Didn't do any damage at all to the car, but even with that minor tap I was soar for two days (the guy wasn't even insured). I hope all of you guys are alright now and in the long-run.

IANAL (I rarely get to use that bit of netspeak :D )

BUT, I do work in and around them and cases similar to this all the time. More than likely, once Torm & Co. retain counsel and such, this will go quickly and easily. That has little to do with the offending driver's culpability and much more to do with the extent of the injuries. If one or more people in the car was seriously hurt (or, God forbid, killed) then the insurance company would be looking at shelling out hundreds of thousands if not millions of dollars. That's the sort of thing that they're going to involve their lawyers in bigtime. They'll dig and dig for any little bit of responsibility of Torm, the owner of the vehicle he was driving, the vehicle's manufacturer, anybody.

However, with the prospect of no serious hospital bills to pay and only having to pony up the cost of replacing a used, totalled vehicle, I'm willing to bet that they just write the check and then drop the drunk from their coverage.

And, by the way, a big shout out to TogaMario who I've not gotten a chance to see in many a Game Day. Hope you can make it again sometime!
