well if you miss you don't crit. If you hit, you might critical threaten ... and if you critical threaten there is a good chance you might critical.

so those low CR, no DR, low HP, Low AC critters out there will be fodder to a character with that weapon (and the ability to use it).

It shouldn't matter, because the general rule with multiplication in 3E is to apply it to the base number only.
 

I'm glad none of my players has figured out this evil trick...I use the Variant Instant Kill rules IMC, although with some modifications to prevent ridiculous situations like a few 19's causing a dragon to drop from 390 hp to dead in one blow...

Still, having a 50% chance of threatening, and a 50% chance of threatening a kill on the confirmed crit (assuming all hits go through armor, DR, etc.), makes for some really lethal combats. Combine that with the Great Cleave/Whirlwind combo, and I can foresee the heads of many mooks flying about in my game...

That would be my standard order of operations.

Nah, a real powergamer'd use a scythe (15-20/x4). Your expected damage is a lot higher, and you don't risk getting attack rolls that are good enough to threaten but not good enough to hit. Now, if that were a vorpal scimitar, things would look a bit different.
