I kinda like terms like "metahumans" though, as it's more neutral than "superhero". Metahuman is what you are, superhero is what you do.
Yeah but superhero is evocative and metahuman is bland. Language matters. Which is why you trademark good words you invented (and have attached to a trade, obviously). We can all come up with alternative terms for great trademarks, but there’s a reason why they were great trademarks. Superhero > metahuman.

Sure. I was thinking more along the lines of diegetic terms. E.g. Nick Fury's document outlining the Avengers Initiative would likely talk about metahumans rather than superheroes, but here on Earth-1218 we refer to the Avengers as a superhero movie and its main characters as superheroes. And now we can refer to the Pouch as a superhero as well without risking the Mouse suing us.

I don’t really recall Nick Fury having a document saying metahumans. Perhaps that’s a clue? Superhero is by far the stronger term. We’re talking about trademarks here. If you’re talking about a different topic, that’s cool, but it’s not what you I’m talking about.
