Mentioning of non-SRD monsters (etc.) in OGL products?

Say for example you wanted to make a list of monsters that were common to an area. Could you list "Illithid", "Beholder", "Death Giant", "Century Worm", etc; so long as you didn't actually give any stats or write up any descriptions of said creatures? I realize it would be almost pointless to even mention them if you couldn't really use them, but I was wondering.
Assuming that the SRD is part of your reference material for your product -- usually, it is -- then strictly interpreting the legal information section (found in legal.RTF), it would be a no-no for the "beholder, illithid, mind flayer," etc., unless you have WotC's permission.

The rule of thumb is: if it's not OGC, then you have to ask permission to use it.
 

So what about using the older version of the SRD before they were designated as PI? My non-lawyer understanding is that once you declare something open content, as they did with mind flayers et al initially, you can't "take it back" later.

The older version before they were PI was a "gentleman's agreement" version, and not officially released under the OGL. Any version that was actually open content omitted the creatures in question.

So that's a no-go.
