I'm sorry to hear about your misfortunes, Ashrem, but glad to hear your wife is recovering.

When you do contact a lawyer, make sure that they will agree to not get paid unless they get a settlement for you. The last thing you need are more bills!

Also, I agree that you might not be able to collect much from this woman. There are several possible reasons for not having car insurance in a state that requires it. 1. You can't afford it. 2. No one will insure you because you are such a bad risk. 3. You're a scumbag. 4. Some combination of the above.

I hope your folks will be willing to co-sign a loan in these circumstances. Lots of couples need help when they are just starting out. I know we did.

Please keep us updated on how everything goes, and give your wife my wishes for a speedy recovery!:)

I think we have already got our lawyer, but if he doesn't work out, you guys who offered will definatly be getting an email.

As far as getting a new car is concerned, well, we'll just have to wait and see.

As pretty much everyone has said, get a lawyer (make sure they're licensed by the Bar Association - I think Alabama is the state that doesn't require that, IIRC) - there are statutes of limitations on these things, after all, you can't afford to wait, obviously.
 

Based off of an accident that totaled my beautiful truck, similer situation, i escaped unscathed, but, my truck was appraised b4 the accident at 16,000, for all the work i out into it, and the insurance co. offered me 3,000 ......I flipped! 3k because of the year.....but to top it all off, the idiot did not have insurance, but i lucked out and he was rich, he just did not feel the need to provide insurance......wierd but true. only thing i can say, is good luck, if you contact the correct lawyer, they might advise you to sue your insurance co. but you would end up having to be insured by a new co.

No real advice, but I'm a little astonished that this lady had no insurance. Isn't car insurance mandatory in the USA?

For the most part, yes, but it's one of those things that's kinda like wearing a seatbelt (Which is also mandatory over here)... it never comes into play until its too late to do anything about it. And a ton of people don't bother to get it, figuring they will never need it. I could name four people I personaly know off the top of my head with no car insurance and still drive.

It's on a state-by-state basis - some states require it, and some don't - and just because it's required doesn't mean that everybody buys it. Car insurance can get pretty expensive, especially for people with bad credit ratings, so a lot of poor folk don't get it.

<ianal>Sounds like you came out (slightly) ahead financially on the loan on your car, by about $800. I know buying a "new" car is tough - but use the $800 as a downpayment on a new car, and get something in the $7.3 to $7.5k range. Your payments won't be any different. Actually, by paying that money to you, in most states the insurance company now has first rights to any money that you recover from her - so that's something to look out for.</ianal>
