It's an interesting decision and one I hope works out for them. Differentiating yourself is important in this market, I bet, and with one of the largest publishers going their own path makes more sense than having to work within the GSL and severely limiting what types of products they can make.
The thing is, we have a system that is modified, but only slightly. They went forward a few steps, but we know that going forward a few more steps can fix a lot of things that got really ugly.
For example, iterative attacks. After seeing how 4e runs at the D&D Experience and seeing how well it works as a house rule, I wouldn't want to go back to the old way.
I'm glad to see they went a more popular route with skills. I think it makes a lot more sense to have a flat rate of improvement. I think my only problem is with the cross class skills. It's an added complication that doesn't really change much.
There is definitely a market for this. A whole pile of cynics will love it. I just worry that the pile of cynics will be too small compared to the people, some ex-cynics, some new players, some fanboys like me, that get into 4th edition.
