The FAQ didn't need to - as with Massive Damage, CDG makes no distinction between lethal and non-lethal damage.

If you CDG with a sap, you automatically hit and score a critical hit; let's say you deal 12 points of non-lethal damage. The defender obviously survives the damage, but then he must make a DC22 Fort save or die.

... unless he has Regeneration, since effects that cause instant death only work if they can cause lethal damage to him.

Let me rephrase. I thought the FAQ clarified that CDG worked on creatures with Regeneration even if it only caused non-lethal damage.

Nevermind. After checking the new FAQ (I hadn't updated in awhile), the FAQ answered a question about delivering a CDG with a non-lethal weapon.

That doesn't make sense. A sap can't deal lethal damage to a person, so how is it able to CDG him then?

An attack that can cause instant death only threatens the creature with death if it is delivered by weapons that deal it lethal damage.

Can a CDG cause instant death? Yes.

Does it threaten a regenerating creature with death? Only if it is delivered by weapons that deal it lethal damage.

You could execute a CDG on a helpless troll with a greataxe, automatically dealing 3d12 + whatever non-lethal damage, but the troll wouldn't be in danger of dying from it.
