What level should the Bolt of Conjuring spell from the Book of Eldritch Might be?

Its listed as a 3rd level spell
Target: 1 creature
Range: medium (100 ft + 10ft/level)
Damage: 1d4/level of magical energy (max 10d4)
Save: None
SR: None
Additional effect: Summons a creature as if a Summon Monster I spell had been cast, except the creature summoned appears immediately

I have already let this into my game - (I must have been drinking!!) - I'm pretty sure when I read it to approve it I thought it did 1d4/2 levels max 10d4. Such is not the case. Now I have to figure out how to deal with it .

Hmmm... what's the problem? Third almost seems weak to me. How is this worse than a fireball? Or, heck, two magic missiles? What kind of problems are you having with it?

The main problem is the combination of auto hit, no save, SR doesn't apply, providing instant flanking, and as "Magical" energy no resistances apply.

After seeing it in play the other night it seemed powerful for a 3rd level spell.

I'd change it to being a specific type of non-magical energy(hell, even let the player choose which one when they learn it), give it a touch attack, then let it stand.

That brings it into line with other conjuration spells (ie - they allow no SR because they create physical forces, and those forces have to be directed).

The Bolt of Conjuring has been updated for 3.5 and the big changes are:
Saving Throw: Reflex half
Spell Resistance: Yes

I knew from reading Monte's board that the spell was supposed to have Save: Yes, see text, meaning you were supposed to get a save versus the bolt, but not again the conjured creature or something like that, but giving it a saving throw AND spell resistance now makes a MUST have spell into a SCREW THAT spell.

But where did you get this info?

The info came from the 3.5 PDF update for the BoEM.

Giving it a Save and an SR check doesn't screw the spell. Of course thats campaign specific - if the PCs rarely encounter creatures with spell resistance it makes little difference, if they are always encountering things with SR it makes a great difference.

I would have been happy with either making it a ranged touch attack or giving it a reflex save and making the energy of the bolt correspond to the creature summoned (negative = evil, positive = good, axiomatic = lawful, anarchic = chaotic chosen by the caster) then allow the appropriate protection from "X" spell provide immunity to the energy bolt.
