lets so you commission me for some art and you pay me half up front. If i don't delver, or Just disappear, I would think you would have the right to ask for your money back.

Probably, but maybe not. That probably depends on all kinds of things such as the jurisdiction, etc. Which is why that sort of thing is generally spelled out in the terms of the contract, to avoid any ambiguity.

Spanish Guy: Here's your sugar, Simpson. Now you give us the money.
Homer (leaving on raft): That wasn't part of the deal!
Spanish Guy (pulls out contract): He's right! Who wrote this thing?

Its not the same. Your example involves a breached contract. The GSL hypothetical involves a revoked license.
