Save Vs Silence

I'm almost embarrassed to ask this question, but here goes.
Silence (formerly Silence 15' radius): Under Save it says "Will negates, see text". In the text it states that if you cast Silence on an unwilling person, they get a save, and if you put it in the air it's immobile and if you put it on a willing creature or object, the effect is mobile. The question now is, if you cast Silence on a willing character who then moves adjacent to an unwilling character, would the unwilling character then get a Will save to not be affected? Likewise, if you cast Silence in the air and then someone walks into the area of effect, do they then get a save? The spell is supposedly proof positive agains sonic and language based attacks, but the saving throw description is starting to make it look subjective.

You only get a save if you are an unwilling TARGET of the spell. If it is an area effect that you move into or that is moved next to you, you do not get a save.

This is correct. If the spellcaster targets the silence spell on an unwilling target, the unwilling target gets a saving throw against the spell. If someone moves into an area of magical silence there is no saving throw for them. They benefit and/or suffer from the effect of the spell.
 



And of course a 3rd level cleric can ready a silence spell whenever he sees a wizard casts. He simply casts the spell within 10 feet of the wizard, which allows no save...thereby normally destroying the spell the wizard was casting...even if that wizard is 20th level.

The 20th level wizard then proceeds to beat the crap out of the 3rd level cleric with a quarterstaff :D.
 


To piggy back the first question and definately muddy the waters: what happens when someone is caught in the AoE of a Silence spell or darkness for that matter who has SR?

I ask because let's say that they resist the silent effect. What does that mean exactly? Does the AoE of the silence they are occupying simply cease to apply to them - because that is not going to help their suggestion when the target can't hear because their is effectively now a silence curtain between the two of them (presuming the target isn't in the silence AoE to begin with)? Do they just pretend the entire spell doesn't exist for them?

It's the same as for the save. You only apply SR if the silence spell is targeted on the character.
