Silence - does it give a saving throw...

The vast majority of the time Silence is cast on a small stone at the opponant's feet. As long as said stone weights less than 5lbs, then it can subsequently be chucked by mage hand.

Does said stone count as "a non-magical item"?

If I wear a piece of cloth over my mouth, will this block the silence effect and allow me to cast? I'd probably still be effectively deaf, which incurs a 20% spell failure chance if I recall correctly.

How about a diving helm?

A platinum dragon springs up and eats you (no save), then disappears back into the ether.

Maybe every wizard can invest ranks in Sleight of Hand, allowing them to cast spells without opening their mouth....

Actually, NONE of my high level casters have ever been even SLIGHTLY discommoded by Silence. I usually use a silenced Mage Hand to launch the object of the silence back at the initial caster. A level 1 spell counters a level 2 spell, and Hilarity Ensues. And before you ask, yes, all of my high level casters have Detect Magic made perminant on them, in case the object of the spell is not readily apparent. If you don't care to spend that much time, just pick up the object in question and put it into your backpack. It is an emination, after all.
Ok, here is a puzzle for you. Cast Silence on a tanglefoot bag, then throw it at the 17th level caster. Mage Hand can't deal with that and the caster will have a hard time casting spells. Thankfully my players haven't tripped to some of these tricks. :D

As others have pointed out, Silence is a near-perfect counterspell. Just cast it 5 ft. from the wizard and voila! His spell is ruined because he is suddenly in a silenced area. A vast majority of spells require verbal components. And having all my spellcasters take the silent spell feat just because the PCs are wont to use it as a counterspell is not an ideal solution. Consequently, I rule that any creature either targeted by OR in the area of a silence spell may make a Will save to negate. Incidentally, I do the same thing with a magic circle forced upon an unwilling creature.

Technically, a tanglefoot bag is destroyed after being thrown, so this plan wouldn't work. However, casting silence on a pebble and tossing it into the goo would.

It is a bard or cleric spell, not a wizard spell. I personally don't allow casting the spell on a point in space, it must target an object or creature.

I don't see a problem with this spell in my game, possibly because as the party gains levels, there are even more effective things to do, than just spoil an enemies spell. Counterspelling in general is very inefficient. Silence is probably the most efficient way to do it, and even then, its not certain, that it is the most effective course to take, especially as a cleric. In order to "counter" a spell with a silence, you have to ready an action. Which won't do much good if the guy activates an item, while you've just wasted an action. At the same time, the teams tank is starting to look pale from the hammering he's been getting.

Dropping that silence may hinder the other spellcasters in the party. It also prevents the players from co-ordinating, or passing any information between the players in the area of effect. All of these situations have come up in my game.

Would it be possible to get a friendly bard to scribe the silence spell to a scroll then have my wizard copy it to his spellbook? It is an arcane spell when cast from a bard. :\
